Acceptance

*Acceptance of these General Terms and Conditions of use (it is a necessary condition to use the lockers service of luggage. *LOCKME reserves the right to make changes to the conditions of use, at any time, although the user of the service will only be bound by the terms and conditions of usage published at the time you made your reservation.

* LOCKME reserves the right of admission to its facilities when circumstances advise.

 

Service features

The service provided consists of the rental of luggage storage/s and

personal items for days.

Service conditions

General features

* The User, person or company that reserves one or more lockers, undertakes to make appropriate and lawful use of the lockers. Its use must comply, therefore, with the legislation applicable, these conditions of use, morality, good customs generally accepted and public order.

 

 

* The user acknowledges and accepts that access and use of the passwords takes place freely and consciously, under your exclusive responsibility. LOCKME will in no case be responsible of the use that the user may make of the instructions, nor of the damages and damages that may arise from it.

* For LOCKME to provide access to the service it is necessary that the user has previously provided the data requested personal information, email and telephone. LOCKME reserves the right to verify the information provided by the user. It is considered a complication and cause for immediate discharge from the service provide data not corresponding to the user.

* In any case, LOCKME may suspend, limit access or terminate any user who does not comply with the provisions of these terms and conditions, without said user can claim any damage or loss from you.

 

Reservation process

* Access to the use of the lockers is subject to prior completion of the corresponding reservation form located at www.lockmemadrid.com

* The data provided by the user at the time of making the reservation must be exact and truthful. The user will be the only one responsible for false, inaccurate, fraudulent and/or illegal that it provides and the damages that it may cause.

* Once the reservation form is completed, paid and verified, the amount via credit card will be sent to the user an email where they will be provided with the access data to the facilities and opening of the reserved lockers, as well as the payment details made. data that will serve as receipt thereof.

*The User is responsible for verifying the size and weight of their luggage before reserving the lockers. Any claim or REFUND request will not be accepted in case that the luggage exceeds the dimensions of the lockers and/or their maximum weight. If for any reason LOCKME decides to refund the amount of the reservation, the user must understand that the refund will be discounted by the value of the commission charged by the collecting entity at the time of managing the collection plus €5.00 as payment as administration fees. **

 

Limitations of use

* LOCKME reserves the right to control the maximum number of lockers reserved by user.

* LOCKME does not guarantee the availability of free lockers.

 

Lack or late removal of deposited objects

* If the User does not empty the contracted locker(s) on or before the reservation expiration date, LOCKME will be authorized to access the lockers to remove luggage and allow them to be used by other users.

* LOCKME will temporarily guard the luggage and will try to contact the user who has not met the deadline of the contracted rental period to manage the return of the luggage to its owner, the payment of the fee will be mandatory.

* After 30 days from the end of the reservation without having been able to contact the user or without the user having contacted LOCKME or having collected the luggage, it will be understood for all purposes that the objects have been abandoned by the user who will exempt LOCKME from any claim thereon while waiving any claim for damages. Under these circumstances, LOCKME will consider the luggage as abandoned, and is authorized to destroy or dispose of it in the manner it deems most convenient.

* If the User contacts LOCKME before 30 days from the end of the reservation to recover the stored luggage, they will have to face the following expenses:

* The amount equivalent to the price of the unpaid lockers for each day that passes from the expiration of the rental without the user having collected the luggage, until the luggage is delivered or collected by the user.

* The costs incurred by LOCKME to manage the shipment of luggage as well as a penalty of €30.

* It will be understood that the delivery of the luggage by LOCKME has taken place from the moment in which LOCKME transfers the luggage to the carrier, LOCKME being exonerated from any responsibility for the luggage from that moment on.

Locker’s Use

* The user is responsible for his or her luggage and personal items, and LOCKME is exonerated from all liability from a valuation of €300.

* The user will observe maximum diligence in the use and conservation of the lockers and must leave their doors closed when the period of use of the same ends.

*The use of the lockers is limited to the user's travel luggage deposit during the validity period of the reservation.

*It is strictly prohibited to deposit flammable, toxic, harmful and/or dangerous substances in the lockers, and the user is responsible for the consequences that non-compliance may have on natural persons, legal entities or things.

* The User undertakes not to make any illicit use of the passwords, contrary to the Law, or that may cause injury or damage to people or things, with the user being solely responsible for such damage if it occurs.

*During the reservation process of the locker(s) as well as during the duration of the reservation, the User will have a mobile phone or any other device with Internet access in which they can receive notifications that enable the use of the reserved locker(s), as well as any other notification that may be necessary to send you during the reservation period. Likewise, the User agrees to keep a mobile phone online that allows LOCKME to contact him if necessary for the proper purpose of the service or in case of force majeure.

* The User is responsible for ensuring that the door of the locker(s) used as well as that of the establishment is correctly closed after depositing the luggage and at the time of collection.

* The User authorizes LOCKME to open and inspect the use of the reserved locker(s) at any time for reasons of safety of people or other people belongings.

* The Reservation Holder may use at his discretion the locker(s) associated with the reservation made from the moment the reservation begins and until its conclusion, except for other information provided in the reservation process such as in the Notification sent with the reservation details will be exclusively from 10:00 a.m. to 6:00 p.m. from Monday to Friday.

User Assistance

* The User has at their disposal an assistance service regarding the use of the contracting platform and handling of the locker(s).

* The assistance service will be available to the User between 9:00 and 2:00 from Monday to Sunday.

Responsibility

* LOCKME offers a space rental service in lockers and is not responsible for the custody of the packages or luggage stored inside, with the User assuming all responsibility for the use of the lockers. LOCKME is not responsible in any case for the theft, loss, theft, misplacement, abandonment of the content of the locker(s) that exceeds €300 per locker in its entirety, even when derived from the correct use of the locker(s).

* The User will be responsible for all damages caused to the locker(s) during their use that were attributable to them. In addition, the user must report any incident related to the Service or the locker(s) through the Assistance service.

* The User will be liable to LOCME for any damages that a use not contemplated in these conditions of use may cause to LOCKME. Likewise, the User will respond by indemnifying LOCKME for any damages or losses that a use not contemplated in these conditions of use results in a claim by a third party towards LOCKME.

* LOCKME will not be responsible for incidents in the operation of the lockers or contracting website in the following cases:

That the locker(s) were not used by the user in accordance with their instructions for use.

That there are problems with the reception of emails to the address communicated by the user, whatever the reason.

That due to misuse of the password(s) the user causes the password(s) or any of its parts and/or components to not function correctly.

For any breach by the user of the provisions of these conditions of use.

Errors, losses or decrease in Internet connection speed, for whatever reason, that could affect the operation of the locker(s) and/or the reservation service.

*The locker(s) may not be available for some reason, such as: maintenance and repair; events beyond the control of LOCKME or that could not have been reasonably foreseen. LOCKME will not, under any circumstances, be responsible for the impossibility of access to the locker(s), nor for any damages that may arise from this.

* LOCKME will NOT be responsible in the event of a sudden breakdown, acts of vandalism, sabotage, lack of electricity, lack of Internet access or any other unexpected situation that prevents the correct functioning of the service or access to the facilities. damages that may arise from this. LOCKME undertakes to use the means at its disposal to limit damages resulting from the malfunction of the service or the supplies necessary for its correct functioning.

 

Force majeure situations

* LOCKME is not responsible to the user for non-compliance with obligations derived from this Contract in the event that the non-compliance is due to a cause of force majeure, meaning, for these purposes, any unforeseeable event that is beyond the control of LOCKME and that makes it impossible to fulfill the assumed obligations, materially or legally, and provided that it is not due to a prior non-compliance of the party affected by the major cause.

* Force majeure shall mean, among others, cases of war, acts of terrorism, earthquakes, lightning strikes, epidemics and pandemics, sabotage, and restriction of freedom of movement in compliance with state laws, rules, regulations or resolutions.

 

Termination of reservation and access to facilities

* LOCKME may terminate or suspend any user's access to the Service immediately if it believes that the User has breached these terms of use.

* If LOCKME terminates the user's access to the Service, the user agrees not to attempt to use it.

* If the user can no longer enjoy the Service, for whatever reason, they agree to leave the locker(s) empty.

Otherwise, the User expressly authorizes LOCKME to destroy any object and/or document found in the locker(s) since it will be considered abandoned, expressly and irrevocably waiving any compensation and/or claim for damages against to LOCKME.

 

Notifications

All communications and notifications that must be made due to these conditions of use must be made by email to the address or physical address indicated below, provided that, in all these cases, proof is left of their proper receipt by the recipient or recipients:

LOCKME will send the notifications that must be made to the user to the email provided at the time of making the reservation, although in case of urgency it may use the contact telephone number provided at the time of formalizing the reservation.

Law and jurisdiction

* These conditions of use will be governed in accordance with Spanish laws and regulations.

* LOCKME and the user agree that any disagreement, dispute, controversy or claim related to the Service that is not resolved amicably will be referred to the Courts and Tribunals of the city of Madrid, with express waiver of their own jurisdiction or jurisdiction
